The following changes are now available in Dataplace and the Training environment:
The latest update introduces the Australian Government Data Catalogue (the Catalogue) on Dataplace, allowing users to search for open, conditional, or restricted data assets. A new side pop-out feature facilitates easy searching, filtering, and reviewing of a wider range of content, with direct links to open data/metadata sources. Organisational administrators can import data assets into the catalogue, which initially includes data from data.gov.au, Geoscience Australia, and a selection of Commonwealth government agencies.
An Authorised officer role has been established to improve the accreditation application process.
The Contact Us link now includes a complaint form for users to lodge complaints. Signed-in users can also report data breaches using a dedicated form accessible through the same link.
The Terms of Use for Organisations and Individuals has been updated.
Individuals - The Dataplace Terms of Use have been updated to incorporate supplementary terms applicable to the Catalogue. This update will ensure that individuals and data custodians are informed about the terms that govern the use of the Catalogue.
Organisations - Supplementary terms have been created for organisations who provide their metadata for the Catalogue.
Organisations Terms of Use include additional terms with respect to the submission of accurate and compliant metadata, intellectual property rights to the Catalogue metadata and other legal rights.

The following changes are now available in Dataplace and the Training environment:
Dataplace navigation has been streamlined to make it more accessible and logical for users, with links to Help and Guides, Accreditation and Dataplace services available from the home page once you have logged in.
You can easily see a list of your data projects, with custodian and requestor tabs separating projects depending on an organisation’s role in a project journey. Only data custodians will see a custodian tab. For organisation administrators and data coordinators, an activity tab shows at a glance the status of all project journeys. If you are a general user you will only see the projects that you’re involved in.
The organisation's nominated group mailbox will receive a notification when someone from their organisation logs into Dataplace for the first time.
Organisation administrators and the nominated group mailbox will be notified when a new data sharing request has been started by a user in the organisation.
Lead requestors can now add other organisations as additional requestors to a project.
The Manage accreditation page has been improved and displays any existing accreditations and an ‘Apply for accreditation’ button, with information about accreditation embedded in the form.
Data Scheme entities can report an event or change in circumstance in accordance with Section 31 of the Data Availability and Transparency Act 2023 using the new Change in Circumstances page.

In response to feedback, the lead custodian’s Approving officer can now refuse a data request at the ‘collaboration in progress’ and ‘for review’ stages in Dataplace.
The Approving officer will be required to provide a reason for refusing the data project.

The Charging of fees by data custodians guidance is now available on the Office of the National Data Commissioner website. It provides information about fees Data custodians may charge data users for services performed in dealing with a data sharing request under the DATA Scheme.

We’ve made great progress in adding additional capabilities to Dataplace. Dataplace users can now commence a data sharing agreement under the DATA scheme. Data users and custodians can enter into a collaborative process to progress an agreement, including the ability to auto-generate, review and amend the agreement. Authorised officers will then be able to physically sign an agreement for uploading in Dataplace. The agreement will then be complete, pending registration. ONDC will complete registration and provide notification once this has been finalised. This is the first step on the road to full end-to-end automation. The ability to commence a DATA Scheme data sharing agreement is also available in the Training environment.
Within Dataplace there are three pathways to data sharing: a Data Scheme data sharing agreement, a General data sharing agreement, and a Project summary (no agreement).
Dataplace custodians and users can select one of two choices for DATA Scheme data sharing agreements and for General data sharing agreements. Dataplace can auto-generate a draft agreement which you may download and choose to adapt or approve as is. If you are using a Dataplace auto-generated agreement, you can select ‘upload adapted Dataplace generated agreement.’ Alternatively, you can choose ‘Upload custodian’s own agreement’ if you prefer to develop your own agreement.You can then upload the completed signed agreement under the Documents tab at the collaboration stage, once parties have agreed on project requirements.
If you’re uploading a project summary (which is not a formal agreement, but an outline or schedule of the sharing that will take place), select ‘Upload custodian’s own agreement.’Once the process is fully automated you will have the choice to select ‘Dataplace generated agreement’ and not need to upload a physically signed document.

Thanks again to our legal engagement stakeholders who have contributed feedback to the consultation process on the General data sharing agreement clause bank earlier in the year. Work to incorporate stakeholder feedback is ongoing. As yet no changes have been made to general data sharing agreements available in Dataplace. We will engage with contributing stakeholders once updates to the clause bank have been drafted. Users will receive a notification when the changes are ready to be included in Dataplace.

Dataplace helps you submit a request for data to any Australian Government agency. It helps define the arrangements to share data and allows you to track progress. Importantly, Dataplace can auto-generate a data sharing agreement, using a new, whole of government clause bank.
With the latest release on 28 April, we add two enhancements to Dataplace services: organisations that share an ABN will be able to onboard to Dataplace as separate entities, and there is increased reporting functionality.
Data requestors and Data custodians can export a report on Dataplace activities (eg requests and agreements) which will include a larger set of information about each data project.
Open the My data projects tab, select export under the key word bar. An excel spreadsheet is generated with information about each of the agreements including lead custodian, data requirements, and type of agreement. The excel spreadsheet has been formatted for easy use in Power Bi. See the help tab for more information.
For organisations that share an ABN but are independent from the organisations they share an ABN with, such as statutory office holders, Dataplace now offers a way to onboard as a separate entity.
The organisation onboarding as a separate entity will only be able to see their own data requests, accreditation applications and data sharing agreements, and user details of their organisation. They will not be able to see any details about other organisations that share the same ABN.
To set up an organisation as a separate entity you will need to provide advice that your organisation, or head of organisation, has independent decision-making capability. The advice must be provided by the person who has the leadership role for data management and use in the organisation.

We are working with the Australian Government Solicitor to incorporate updates to Dataplace’s General clause bank (used to autogenerate a data sharing agreement under the General sharing pathway on Dataplace). Updates are expected to be published in June.
Also coming in June will be the ability to auto-generate a DATA Scheme data sharing agreement.

The agreement service is now live! And we need your help.
You can now create a general data sharing agreement using Dataplace. The service can help you generate an agreement for sharing where there is a single data user (organisation) and a single data custodian. Enhancements over the coming months will see the service expand to include developing agreements when data is shared under the DATA Scheme, and when sharing involves multiple custodians, multiple data users, and intermediaries that provide data services, such as Accredited Data Service Providers (ADSPs).
We are currently engaging with Dataplace stakeholders on the clause bank used to generate agreements, to check we have got the right legal management of the right risks when sharing data.
