Dataplace is a digital platform that supports better availability and use of data, including under the DATA Scheme.
Dataplace is managed by the Office of the National Data Commissioner (ONDC) and the Department of the Prime Minister and Cabinet on behalf of the Australian Government.
You can use Dataplace to:
Defined words in this document are in bold and the meaning of these words are provided at the end of this document. When we refer to you or your, we are referring to you, as the individual accepting these Terms.
By accessing Dataplace, you agree to be bound by these Terms of Use (Terms). Importantly, this means making sure you know and comply with your responsibilities.
Certain services or features have additional terms, which are specified at clause 7, and are considered part of these Terms.
You agree that you will only access and use Dataplace in a professional capacity and for purposes related to the Dataplace Organisation that has assigned your user account.
You must not:
By accessing Dataplace, you agree to the collection, use and disclosure of your personal information as set out in the Dataplace Privacy policy and Privacy collection notices.
You should be aware that we monitor the use of Dataplace. We monitor for a range of purposes, including to help detect when Dataplace may be being misused.
You must use confidential information only for the purpose(s) specified and not disclose confidential information without prior written consent. You must protect confidential information from unauthorised use and disclosure.
You may disclose confidential information when compelled to do so by law, or authorised government agency, if you give us reasonable prior notice, unless a court orders that notice does not need to be given.
We may suspend or terminate your access to Dataplace at any time. We may do this, for example, to protect the security and functionality of Dataplace services.
If you do not comply with your responsibilities (as specified at clause 2 above), we may also suspend or terminate your user account. In addition, we may suspend or terminate the user account opened by your Dataplace Organisation, should you fail to comply with your responsibilities.
The Dataplace Organisation that opened your user account may also terminate or suspend your account, access to or use of Dataplace at any time.
If your Dataplace access is suspended or terminated, you must continue to abide by these Terms during the suspension period. In addition, we are not required to provide you access to Dataplace services and we are not responsible for missed opportunities or losses due to your inability to access Dataplace.
Dataplace services are delivered with ‘best endeavours’, ‘as is’ and without charge. We will make efforts to rectify issues in a timely manner once identified and as required to deliver Dataplace services, but do not warrant or guarantee that:
You agree that you will take adequate precautions to protect your systems against any risks associated with accessing Dataplace.
We will not be liable to you (whether in contract, tort, equity, statute or otherwise) for any loss or damage (including special, indirect, consequential or exemplary damages) that you suffer as a result of, or in connection with, your use of Dataplace.
The Catalogue has additional terms that are part of these Terms.
The Catalogue provides a platform for browsing information about data (Catalogue metadata) held by Commonwealth agencies (Data custodians). Catalogue metadata may be subject to additional terms and conditions imposed by Data custodians.
You agree to use the Catalogue solely for lawful purposes and in compliance with any applicable laws and regulations.
You may not modify, adapt, reproduce, distribute, or create derivative works based on the Catalogue metadata without prior consent from the Data custodian.
The Catalogue is provided on an "as is" and "as available" basis. We do not warrant that access to the Catalogue will be uninterrupted, secure, or error-free.
We make no representations or warranties regarding the accuracy, completeness, or reliability of the Catalogue metadata provided through the Catalogue.
The Terms may change from time to time, and it is your responsibility as a Dataplace user to be aware of the new Terms.
The laws of the Australian Capital Territory apply to these Terms. The courts of the Australian Capital Territory shall have non-exclusive jurisdiction to decide any matter arising out of the Terms.
In these Terms, the following words and expressions have the meaning set out below.
Catalogue means the Australian Government Data Catalogue.
Catalogue metadata means information about the open and restricted data held by participating government agencies, and related information, provided by Data custodians for the Catalogue.
Conflict of interest means any matter, circumstance, interest or activity that may or may appear to impair the ability of you to act diligently and independently, including due to any conflict between your obligations to the Dataplace Organisation and your obligations to another person (such as another Dataplace Organisation) or your personal interests.
Confidential information means information on, or contained in, Dataplace that is either marked as “Confidential” or that a reasonable person would assume to be confidential or proprietary given the terms of its disclosure, but does not include information that:
DATA Scheme means the best practice scheme established under the Data Availability and Transparency Act 2022 (Cth) to facilitate and regulate the sharing of Australian Government data.
Data custodian is an organisation that has the authority to make decisions about sharing requested data, whether alone or jointly with other entities. Data custodians include the Commonwealth bodies defined as “data custodians” under the Act.
Dataplace means the digital platform that you can access through your user account.
Dataplace Organisation means an organisation, business or entity that has registered an organisation profile with Dataplace.
Organisation administrator means the person, or persons, nominated to act in that capacity on behalf of a Dataplace Organisation in respect of their Dataplace organisation profile.
Privacy policy means the statement found at the associated link as updated from time to time.
Terms means these Terms of Use.
'We’, our or ‘us’ refers to the Australian Government represented by the Office of the National Data Commissioner, which is in the Department of Finance.
‘You’ or ‘your’ refers to you, as the individual accepting these Terms.
